TheNextBigWriter, LLC (“TheNextBigWriter,” “we,” or “us”) provides this Privacy Policy to inform you of our policies and procedures regarding the collection, use, disclosure and protection of information that apply to our Service (as defined below), as well as your choices regarding the collection and use of information. It is important that you read this Privacy Policy together with any other privacy notice or fair processing notice we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This privacy notice supplements the other notices and is not intended to override them.
a. Overview. TheNextBigWriter offers a platform for users to virtually workshop their books, short stories, novels, and other writing online. Users create profiles in which they can enter in information about themselves including a pen name, age, gender, city, and general biographical information. They also upload their content, leaves feedback for others writers, leave notes for other members, and become fans. By using our platform and software (collectively the “Service”) you understand and agree to the terms of this Privacy Policy. You further understand that the Service is a public platform.
b. Applicability and third-party websites and services. This Privacy Policy only applies to the information we collect when you use the Service or view the comments and does not apply to any website that uses the Service or other website linked to from the Service. We are not responsible for the practices employed by websites linked to or from the Service, including Partner Sites, or the information or content contained thereon. Please remember that when you use a link to go from the Service to another website, our Privacy Policy is no longer applicable, it also does not apply to the Partner Site on which you are commenting. Your browsing activity and interaction with any other website, including those that you link to from the Service, is subject to that website's privacy policy.

Clear Gifs (Web Beacons) Information: When you use the Service, we may employ clear gifs (also known as web beacons) which are used to collect Technical Data and information such as online usage patterns. We may also use clear gifs in HTML-based emails sent to our users to track which emails are opened and which links or advertisements are clicked by recipients. We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:
a. We may have to share your personal data with the parties set out below for the purposes set out in the table in paragraph 5 above. Internal Third Parties as follows: Stripe Payment processing to process payments including: Membership payments and other voluntary upgrades or services.
Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy notice.
Third party marketing services such as Facebook to help us reach audiences and attract new users to the service. In this case, we may load anonymized user data into these services to help us build profiles of our users to reach similar audiences.
In addition to the above, we may access, preserve, and disclose your personal data, including your Identity, Contact, or Technical data, if we believe doing so is required or appropriate to comply with law enforcement requests and legal process, such as a court order, government request, or subpoena, or to meet national security or law enforcement requirements. We may also access, preserve, and disclose such personal data if we believe in good faith that disclosure is necessary to protect yours', ours' or others' rights, property, or safety, or to investigate fraud.

We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.
a. Your Account. All registered users may review, update or correct the Identity, Contact and Profile data by changing their “user preferences” in their account. In addition, members may shut down or delete their accounts by visiting this page.
b. Opting Out of Our Newsletters and Promotional Emails. You may opt-out of Newsletters and promotional emails from us at any time by using the opt-out mechanism contained in such emails (also referred to as "unsubscribe"). You will still receive transactional emails necessary for the TheNextBigWriter service to function, these include, but may not be limited to, emails confirming you created a new account, emails helping you reset your password etc.
c. Declining Cookies. If you do not want to accept our cookies, you can adjust your browser settings to decline cookies. You should note, however, that certain areas of the Site may not operate properly if you decide not to accept cookies.
d. Change of Purpose. We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us. TheNextBigWriter uses commercially reasonable safeguards to preserve the integrity and security of all information collected through the Service. To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from TheNextBigWriter. Notwithstanding the foregoing measures, TheNextBigWriter cannot ensure or warrant the security of any information you transmit to TheNextBigWriter or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed. Your privacy settings may also be altered by accessing the Service through a third party such as social networks. TheNextBigWriter is not responsible for the functionality or security measures of any third party.
California law gives residents of California the right under certain circumstances to request information from us regarding the manner in which we share certain categories of personal data with third parties for their direct marketing purposes. i. Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
ii. Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
iii. Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
